FHWA has released a new memorandum detailing the applicability of prevailing wage rate requirements. All laborers and mechanics employed for National Scenic Byways Program construction work on Federal-aid highways must be paid wages at rates not less than those prevailing wages as determined by the Secretary of Labor under the Davis-Bacon Act. In general, this means that the prevailing wage rate requirements apply to any National Scenic Byways Program construction project that takes place in the right-of-way of a highway functionally classified as an arterial or collector, but do not apply to projects located on highways functionally classified as local roads or rural minor collectors, nor does it apply to projects that are not located within the right-of-way.
